Just a note to warn you that Bubble Scuba on Ebay is selling what they say are Ultralight parts and they are not.  We do not sell to them.  They have copied our products and even put our name on the arms.  They use our name in all their
auctions including our part numbers.  Please be aware when buying from them as
these parts are made by someone else outside the US and who knows of the quality.  If the price is too good to be true then you get what you pay for.

Hi Terry -- that stinks, is there any way you can get eBay to take some action to get this stopped?

I don't know how it works in cyber-space, but if a bricks & mortar store knowingly abets the sale of counterfeit products they could be liable to criminal prosecution ... at which point, your problem becomes eBay's problem too, and they have much bigger resources to go after this kind of scammer.

I suspect Terry's taking action as we speak.  eBay does have a policy, but unless someone complains, they likely don't have the bandwidth (or strong desire) to check often.  You can report suspicious listings:

I have been trying to work with Ebay on infrigement of intellectual copyrights; but I am not getting anywhere.  Finally got a phone # and maybe I can talk to someone.  They can't seem to
see what has been copied, since it isn't the pictures; but the words are all copied.  They even use the word pivot as a description for some of the parts that has no relationship
to our pivot.

Will keep this forum posted on what they say.  I am sure if they make this person pull the items then they loose money so I don't thing they have any incentive to help me.

I hear you, trying to get a big corporation to accept they should take action which might impact their profits is always a challenge.

One thing you might try is to get the state Attorney-General's office involved -- in Massachusetts, they run the consumer protection office, not sure what it's like in Ca. or whether it extends to protecting the rights of companies too.

My wife has found simply mentioning the AG has a sudden and very positive impact when dealing with customer service people at the phone company, the electricity company, etc. Meaning, even if the AG does nothing for you, the mention of it might get the attention of the eBay people.

Thought I would see what the e-bay seller would say about the arms......so I sent this question to the seller:



Dear sherry_grainger,

are you sure those are the Ultralight arms? they don't look like they are. Ultalight arms come with black o-rings..not red. Inon comes with red. Just want to know for sure what they are.

Dear brant-d,

According to my provider they are Ultralight, no customers has problems with them. We do not use the black o-ring becasue that is rubber, thus we use a red colour one that is made with sillicone material and their life time is 4 times longer than the normal rubber. But if you really want a black colour one, I can replace it yet the quality is not as good as the red one.

Personally I think they KNOW they are not Ultralight.  Notice the choice of words concerning the use of Red o-rings rather than black...."We do not us the black o-ring becasue it is rubber, thus we use redcolour one....."

Thanks for asking, I sent this person a letter stating that I was a dealer of Ultralight products and I couldn't buy wholesale for the same prices that
they were selling any of these parts on ebay for.  I was told I could purchase from them if I wanted to.  There is no way they can be ULCS parts at those
prices.  The copies of our products that other companies have made are made in China and the aluminum coming out of China is very questionable.  (Remember infant formula, drywall, toys, etc).

Fantasea and others have copied our products over the last 5 years.

We have even had items returned to us because they broke, guess what, they were not our products.  We have never had a broken part in 15 years of business.

This was her reply: <"Dear Sir , we got a very competitive prices from our vendor,I also can offer a good price for u. If u have any question , please feel free to contact me. Waiting for your soon reply. wish we can make business together in the future soon. BR. Sherry.

I just don't like them using our name to sell their products with and also putting our name in the middle of their arms.  They even painted it
white so you could see it easier.  They also us the word "pivot" which has nothing to do with the arms.  I think they are reading off an old
brochure when we sold lots of nikonos pivots and it was on the cover of the brochure.

I called ebay and requested a call back, they gave me their number in an e-mail and they have yet to return the call.

I think this is more of someone importing or atleast selling "knock-offs" and representing them as "orginals" than infrigement of intellectual copyrights. I think you may get more of a response from e-bay going at them in that direction. Federal law is very clear on the sell of "knock-offs", the law is not as clear on intellectual copyrights. These folks are representing them as ultralight products when they are clearly not.

Terry - I'm very sorry to hear this. It's a terrible feeling when someone copies what you have done.

I made the mistake of buying Ultralight knock-offs a few years ago when I first bought my dSLR.

The quality was not good and the clamps completely froze up after a few months.
